CAN THE 1972 ACCESSION TREATY TO THE EU BE REPEALED?
The
answer is ‘Yes’ as with all Acts of Parliament though there is some such
as have given full independence to our former Dominions (Statute of
Westminster 1931) would in reality be ignored by the countries concerned. ‘No
Statute can make itself absolutely secure against repeal. There is nothing to prevent any parliament from enacting that a
particular statute shall never in any circumstances be altered or abrogated,
and at certain troubled periods of history this seems to have been the
intention of the legislators’ (See
Dicey, Law of the Constitution, ch.1, and 1Bl.Comm.90) But
it is equally clear that there is nothing to prevent any subsequent Parliament
from treating such a provision as pro non-scripto. In any enlightened government, an
unrepealable statute is a contradiction in terms, striking as it does at the
very root of legislative theory. Its
practical dangers are also manifest, for it turns the ordinary process of
legislation into a constitutional issue so grave as to involve the danger of disorder and
revolution. Yet
laws of this kind
have not been
unknown in some countries even in modern times. Thus in 1884 the French Assemblee Nationale enacted that the
republican form of government could not be made the subject of a proposal for
revision. It is noteworthy that one of
the earliest and most uncompromising advocates of unlimited sovereignty Bodin,
deprecated any attempt to make laws unrepealable. The
real and actual, though not legal, restraint upon legislation is the public
opinion of the country at large. Despite certain theories to
the contrary, few free modern communities have yet reached a stage at which
laws are the creation solely of the individuals who happen to compose the
legislative body. [These comments were written in 1946 but since then this
is exactly what has happened by stealth in YOUR Parliament since Edward
Heath in the early 70’s.] Legislators, at least in democratic countries are still representative enough to be unable to flout with impunity the main currents of contemporary opinion.’ [Well!
that is as we all now know untrue as why are we in 2005 only possibly month’s
away from a Referendum to decide whether we remain a Free Independent
Nation-State - which was foreseen by some over 33 years ago.] So
beware of politicians placing as much difficulty in the path of the eventual
repeal of the 1972 Accession Treaty.
One
cannot fail to remember that there are many Lawyers in YOUR Parliament possibly
many of whom have had a hand in bringing our country close to losing its own
right to rule itself by its own Common Law of England in YOUR Parliament at
Westminster which if you all don’t cotton soon will be but the local branch of
the Brussels Empire. In
the early years of Parliament in the 13th century the members of the
Chamber came to ban the legal profession from their midst because of the way
the profession used the precincts of the House to conduct their own profitable
business, as many of them do today in order to ensnare the people unknowingly
into a New European Super State which had been planned over 60 years ago by our
own politicians-such as Macmillan and Edward Heath and every Prime Minister since. The
only Premier who tried to stem the tide Margaret Thatcher was deceived by her
own praetorian guard and suffered for her stand to prevent what is now possibly
only months away -the Referendum which will decide the future of our once Free
Nation-State. When
one considers the great harm that has been accomplished in just eight years by
many members of the profession in all the main political parties who have made
their decision to push ahead with their dream of Britain being fully enmeshed
in the European Police State and to ignore the millions possibly now tens of millions
of voters who now are saying: ENOUGH IS ENOUGH Who
do not wish to be part of a mammoth collectivist nonentity where everybody must
conform to their moronic pattern? To
give you an idea of what you should avoid we now include a letter which a reader

The PEOPLE of GREAT BRITAIN should be allowed the option of opting out of the EUROPEAN CITIZENSHIP if they so wish. The GOVERNMENT will then be able to provide those who have opted out with BRITISH DOCUMENTATION -only such as British (not EU) passports, driving licences and other national documents. EU laws will also NOT APPLY to those who HAVE OPTED OUT OF EUROPEAN CITIZENSHIP
