The Judiciary – A Defence of English Freedom?

 

Because of the Unique place of the Judiciary in our Constitution and their protection from summarily dismissal except for certain specified offences and can only be removed on the two-thirds vote of members of each House of Parliament.  Because of their security of tenure they are able to exert their influence to protect the People from a despotic Executive –if they choose?

 

‘’As a distinguished Professor of Law John Alder has shown -the doctrine of Parliamentary Supremacy provides the Fundamental legal premise of the UK Constitution. It rests only upon general acceptance by the Courts. The doctrine means that an Act of Parliament must be obeyed by the Courts, that later Acts prevail over earlier ones, and that rules made by external bodies, for example under International Law, cannot override Acts of Parliament. It does not follow that Parliament is supreme politically although the line between Legal and Political Sovereignty is blurred.

 

  Parliamentary Supremacy rests on frail foundations. Without a written Constitution it is impossible to be sure as to its legal basis other than as an evolving practice, which is usually said to depend on the 1688 Revolution. It is possible to maintain that the Common Law [of England] is really Supreme.

 

 

 

Parliament is itself a creature of the Law. The customary and statutory rules, which have evolved since Medieval Times, determine that, except in special cases, Parliament for the purpose means the Queen with the assent of the House of Lords and House of Commons. The Courts can determine whether any document is an Act of Parliament in this sense, but cannot enquire into whether the correct procedure within each House has been followed.

 

The doctrine has two separate aspects: first that the Courts must obey Acts of Parliament in preference to any other kind of legal authority, and second, that no body including Parliament itself, can place legal limits upon the Freedom of Action of a future Parliament. The first of these Principles is generally accepted, but the second is open to dispute.

 

The doctrine is subject to considerable attack.

 

The ‘redefinition’ argument proposes that by altering the basic requirements for law-making Parliament can effectively limit itself, just as it could if it abolished itself in favour of a more limited body.

Grants of Independence to dependent territories; these can probably be revoked lawfully in the eyes of UK Courts.

 

The possibility that parts of the Acts of Union with Scotland and Ireland are unchangeable; this is probably outside the Courts’ jurisdiction.

 

The idea that Parliament limited the Freedom of future Parliaments in relation to certain laws made by the European Communities. The implied repeal Principle has been modified but Parliament probably retains the ultimate power to override an EC rule.

 

There is a separation of powers between Parliament and the Courts. The Courts interpret statutes and can do so according to their own views of what the statute means. These are not necessarily the same as Parliament’s views. There is a thin wedge between interpretation and disobedience which sometimes creates

 

More fundamentally it can be argued that Parliamentary Supremacy was created by the Courts who can therefore withdraw it.’’

At this critical time in the life of this Nation the People look to their legal Lions about the Throne to Protect their Freedom and their way- of- life, which has evolved over thousand years and in much of that time protected by the Customs, Traditions and Laws within the Common Law of England.

 

In the words of a great Frenchman –‘’Laws are always unstable unless they are founded on the manners of a Nation; and manners are the only durable and resisting power in a People’’.

 

Our own Defender of Freedom of our kin across the ocean also expressed the view that ‘’ In effect, to follow, not to force, the public inclination, to give a direction, a form, a technical dress, and a specific sanction, to the general sense of the community, is the true end of legislation’’.

 

 A Chief Justice of England an ardent Defender of the Common Law of England at a time of tyranny who expressed the view ‘’Reason is the life of the Law; nay, the Common Law itself is nothing else but reason’’.

 

And our last remark by William Pitt at another great epoch of our history when our Country at War faced almost all the Nations of Europe - who exclaimed ‘‘where Law ends, tyranny begins’’.

 

There is no place in the New European Constitution for the historic protection of our English Common Law.

We are told on the BBC  (Brussels Broadcasting Service) at 11.30 pm on Saturday the 23rd December, 2007, that the QUEEN now has a website which has footage of the Royal Family in the past and that the QUEEN is NOT

'Stuck in the past'

Well! as far as many patriotic subjects are concerned we need to remain in the PAST when it concerns the protection of  our

FREEDOM and COUNTRY.

 

Change we have had and will continue to have but it must not threaten our very WAY-OF-LIFE our Common Law of England and all which makes our country the most unique parliamentary democracy in the world.

THERE CAN BE NO SURRENDER!

 

Should the Monarch fail to protect our inherited RIGHTS and Liberties then we shall have to fight for a REPUBLIC  as happened in the 17th century because the Monarch of the day ignored those very 'Rights and Liberties of Englishmen' which will still survive in the English Speaking World today in December 2007. How can the MOTHER of PARLIAMENTS give away what is already our and our children's  INHERITANCE which cannot be taken away by

PARLIAMENT or the QUEEN.

 

If the above publicity exercise is to be used to soften the impact to the population of the BETRAYAL of their CONSTITUTION and COUNTRY then it would be the greatest TREASON by a Monarch since James II who sold our COUNTRY to the FRENCH for MONEY and RELIGION.

We now learn from the Daily Mail COMMENT on Christmas Eve that the Queen's Speech will cover the catastrophic fall in Values and Moral behaviour since the beginning of her 56 -year reign. This has been brought about by the actions of HER MINISTERS and the greater number of those in HER PARLIAMENT who have placed THEIR CONCERNS before the INTERESTS of THE PEOPLE and NATION STATE.

 

 As for the fact that HER PEOPLE feel LOST that has been the direct result of the actions of HER SUCCESSIVE GOVERNMENTS and the TRAITOROUS POLITICIANS including PRIME MINISTERS who have stealthily over the 56 years of HER MAJESTY'S REIGN have almost achieved their aim of ENSLAVING the PEOPLE to a FOREIGN POWER. 

The reason for the marked drop in the number viewing THE QUEEN'S SPEECH is no doubt because the mass of people have realised years ago that the MONARCH is powerless to PROTECT their WAY-OF-LIFE and events up to now have PROVED THEM CORRECT.

There is a well know saying 'Nero fiddled while Rome burned'

Is it the case on Christmas Day 2007 while the  Monarch talks  our Rights and Liberties are being taken from us under our very  noses?

Of course the QUEEN under HER CONSTITUTIONAL ROLE can only 'Advise and Warn' HER MINISTERS but when the matter concerns the very LIFE of an INDEPENDENT STATE we expect that HER MAJESTY consider the arrangement to be AT AN END as it would make a MOCKERY of the PRIME IMPORTANCE of the MONARCH to protect our inherited Rights and Liberties which HER MINISTERS  are endeavouring TO GIVE AWAY.

We as loyal subjects of the MONARCH who is the living embodiment of OUR RIGHTS and LIBERTIES  ask at this late stage with only months to the eradication of a FREE NATION STATE some veiled comments that HER MAJESTY will PROTECT our RIGHTS and LIBERTIES.

As for the MORAL tone of the NATION STATE at this most crucial time in ENGLISH CONSTUTUTIONAL HISTORY this matter should be left to CHURCH LEADERS who's responsibility it is to CARE for their FLOCKS particularly at this FESTIVAL of CHRISTMAS.

IF HER MAJESTY'S SPEECH has not been pre-recorded  we ask HER MAJESTY to give those MILLIONS of HER subjects some hope that their PROTECTOR has NOT FORGOTTEN THEM.

Should this APPEAL not be answered we can at last confirm that the MONARCHY is after all nothing more than a talking shop suitable for YouTube and therefore nothing more than a
