A MURDER charge
against a British soldier accused of shooting dead an Iraqi civilian was
dropped yesterday after a dramatic U-turn by prosecutors.
Trooper Kevin Williams had been due to appear at the
Old Bailey, the first member of the British forces to face a murder charge over
post-war operations in Iraq.
But yesterday the 22-year -old from the 2nd
Royal Tank Regiment was told he had been cleared after the Director of Public
Prosecutions Ken Mac Donald ruled there was no case to answer.
It was unclear last night whether the decision would
have implications for other British soldiers facing charges, including murder,
which have been criticised as ‘Politically driven’.
The
prosecution of Trooper Williams had always been controversial with claims that
it could endanger the lives of soldiers who have a split second in which to
decide whether to open fire or not.
The murder inquiry had centred on the shooting in
August 2003 of lawyer Hassan Abbad Said, a father of nine. Trooper Williams was a part of a patrol that
stopped a truck suspected of carrying weapons and anti-aircraft shells in the
town of Al Dayr, near Basra.
Mr Said, who was licensed to carry a handgun, is
reported to have been shot in the chest after Trooper Williams feared he was
about to snatch the weapon of a Royal Military Policeman.
The dropping of the charge will raise questions over the
original decision to proceed, putting the soldier through an unnecessary
seven-month ordeal.
Last
night his mother Julie, 47, said the family had been through a
‘nightmare’. Speaking at their home in
Nelson, Lancashire, she said:
‘To say I’m pleased is an understatement. It’s such a huge weight off all our
shoulders. He was just doing his
job. This should never have happened.’
A delighted Trooper Williams was told of the
decision on Monday and was said to have been ‘stunned’ at the about turn. It followed a campaign headed by General
Sir Anthony Walker, ex-Deputy Chief of Defence Staff.
Senior officers argued that the prosecution could
only undermine the morale and confidence of Britain’s soldier in Iraq.
Last night they said the decision was a ‘victory for
common sense’.
The charge was brought after Scotland Yard officers
were asked to review the case by the Attorney General Lord Goldsmith following
a decision by Trooper Williams’s own commanding officer that no prosecution
could take place.
This meant that any charges would have to be brought
before a civilian court. All UK
military personnel serving overseas are subject to ordinary British laws as
well as Military law.
The Crown Prosecution Service refused to comment
yesterday. It is reviewing 11 other cases to decide whether there is sufficient
evidence to bring charges.

[There should be an in-depth Inquiry into the whole
affair as the timing of the announcement smells of a political move by Tony
Blair to get all the embarrassingly stark examples of politically - correct
decisions reversed before the start of
the campaign for the General Election on May 5 and there is the Khaki vote to
consider at Home and Abroad.
The Real
Murderers are those who connived at all levels of the Blair Government to go to
war in Iraq.
There is also the signing of the Human Rights Act in
1998, which has caused New Labour so many headaches, which they richly deserve,
but what a mess it has made to our once sensible approach to many of the
problems we face in our society today.
We must remember that there are eleven other
soldiers awaiting a decision-so it is not the time to take off the pressure in
order that the new Government on May 5 gets the message loud and clear - LET
THE ARMY DO ITS JOB WITH OUT POLITICAL INTERFERENCE. ]
