IF WE DESTROY OUR RIGHT OF FREEDOM TO FIGHT
A WAR ON TERROR-WHO WINS?
In
the Daily Mail on Wednesday, March 2nd 2005 an article by John Mortimer on
a subject which no inhabitant in our Island would previously expect to be
highlighted in a once Free Country shows the depths to which a Government in
the early years of the 21st century can destroy the very Key-stone
of our Constitution which is considered world -wide as the essence of English
Freedom.

A SHAMEFUL DAY
FOR LABOUR
AND BRITISH JUSTICE
Without exploding a suicide bomb or firing a shot, the
terrorists have managed to strike a successful blow at our most cherished
institutions.
They
look like succeeding in destroying our civil rights and liberties, our right to
a fair trial and the proper protection of the law.
And,
as I say, they haven’t had to move a finger to do it. Mr Charles Clarke and the Government have been only too eager to
do the work for them.
On
Monday night, the Government’s shameful and ill thought out anti terrorist legislation
was passed amid a Commons revolt which resulted in Tony Blair’s majority
falling to 14 votes.
And
this was after the Home Secretary had abandoned the most contentious part of
the Prevention of Terrorism Bill, a Bill which would allow the Government to
put suspects under House Arrest without trial.
It
would mean any British citizen could be detained, for an indefinite period, in
his or her home without knowing what they are accused of and without being
allowed to challenge the evidence against them.
Muddled
If
this muddled, unnecessary and destructive law reaches the Statute Book, it
will be a victory for terrorism.
Charles
Clarke has dismissed
talk of civil rights as ‘rhetoric’ and has said that he is tired of being
patronised by lawyers.
But
what he calls ‘rhetoric’ is our centuries-old pride in the right to a fair trial
- an unshakeable privilege that has been called the golden thread running
through our justice system and has made it the envy of the world.
It
was the Magna
Carta in 1215
that gave us the right to a fair trial, and the 1628 Petition of Right that followed ensured there
would be no
imprisonment without such a trial.
In
contrast to European countries, we have the right to habeas corpus,
after the Habeas Corpus Act of 1679.
Translated
from the Latin habeas corpus means ‘you should have a body’,
for under the Act a judge can command the Government to bring any body -or person
- in its custody to a specified court for a trial to ensure he is accorded
due process of law.
These rights didn’t come
easily. They were fought and striven
for over the centuries, and preserved during times of far greater danger than
we are facing today.
Even
if we assume that the dangers are as the Government and the Secret
Services say they are - the same Government and Secret Services, remember that led us into the Iraq war
on totally unreliable information - this would be no excuse for the wanton destruction
of our hard-won rights and liberties under the law.
The
truth of the matter is that we have a Government, which has shown itself as
impatient and contemptuous of civil rights as it is of proceedings in
Parliament; and its Home Secretaries have snipped off more of the golden thread
than those of any party before them.
Jack
Straw brought in plans to restrict the right to trial by jury. In rape cases, inroads have been made on the
presumption of innocence, another precious right which separates us from other
European systems.
David
Blunkett, totally ignoring the right to free speech, introduced a Bill stopping
people from criticising or even making jokes about other religions.
And
he plunged into the shame of imprisonment without trial - locking up nine
foreign citizens suspected of terrorism in Belmarsh Prison, only to have the
Law Lords insist they must be set free.
Now
Charles Clarke has launched his attack on the Magna Carta, a subject of such
apparent unimportance to our present rulers that Parliament was allowed only some six hours
to discuss it.
As Edward Leigh, the Tory MP for Gainsborough said during
the debate, this amounted to just one hour for every century that had passed
since the Magna Carta was signed on the island of Runnymede.
Dictatorship
The
Bill as it was originally presented to the House of Commons -with brisk
instructions to get on with it because the Belmarsh prisoners are due for
release on March 14 -beggars all description.
It
is less like a provision that might be suggested in a country allegedly
civilised under the RULE of LAW than the arbitrary regulation of a backward
dictatorship.
A
politician, who happened to be Home Secretary could order the House Arrest, the isolation, the
removal from his or her family and friends, of any British citizen, and forbid
them to communicate, make telephone calls or use the internet.
The advice on which the Home Secretary would be relying
would not be made public, and the victim would have no idea what was happening
or what the charges were.
It’s only too easy to imagine this very secret weapon
being used by some future ruthless politician to stifle and silence dissension
or immobilise lawful protesters.
Clearly,
as it stood, it was a proposal that couldn’t be accepted in any country proud
to live under the RULE of LAW.
Mr Clarke’s concession, introduced in the most cack-handed
manner by a letter to the Opposition, delivered in the middle of the debate,
hardly took a step back to the Magna Carta.
A
Judge would, after all, be asked to look at a case of House Arrest, but
could do so only after the politician had decided it.
What
sort of an effective trial the judge could conduct is extremely doubtful, and
he would have no power to interfere with the banning of telephone calls and so
on that the politician had commanded.
This week, a young man, said to have been a bright grammar
school boy - but an undoubted terrorist -was put on trial for planning to blow
up a transatlantic plane with explosives in his shoes.
Rhetoric
He stood in the dock at the \Old Bailey, there was nothing
secret about his trial and he knew exactly what the charges against him where.
If
he hadn’t changed his plea to guilty, his trial would have been conducted along
the lines of the golden thread, which stretches from Magna Carta to today.
If
one terrorist can be tried, and I mean really tried and not merely his guilt
decided by a politician, why can’t they all be arrested, charged and have the
case proved against them?
Merely
to ask such a question would, presumably make Mr Clarke sigh heavily, mouthing
about rhetoric and being patronised by lawyers.
It’s
so much easier to enact ‘justice’ by signing where the Secret Services ask you
to sign and by doing so to cut someone of from life for reasons, which he or
she may never know.
For
his part Tony Blair says that protection from terrorism is more important than
civil liberties.
Tony
Blair is wrong. Of course terrorism must be fought, terrorists caught, tried and, if
guilty, convicted. But this is only half the
battle.
We must learn to defeat them without being scared into
betraying the most precious things we have struggled to establish over hundreds
of years.
If
we don’t do this, we may, perhaps, win the war against terrorism and then find
out that we have lost the very civilisation we were fighting for.

Well! as far as many patriotic
subjects are concerned we need to remain in the PAST when it concerns
the protection of our
FREEDOM and COUNTRY.
Change we have had and will continue
to have but it must not threaten our very WAY-OF-LIFE our Common Law of
England and all which makes our country the most unique parliamentary
democracy in the world.
THERE CAN BE NO SURRENDER!
Should the Monarch fail to protect our inherited RIGHTS and
Liberties then we shall have to fight for a REPUBLIC as happened in the
17th century because the Monarch of the day ignored those very
'Rights
and Liberties of Englishmen' which will still survive in
the English Speaking World today in December 2007. How can the MOTHER of
PARLIAMENTS give away what is already our and our children's
INHERITANCE which cannot be taken away by
PARLIAMENT or the QUEEN.
If the above publicity exercise is to be used to
soften the impact to the population of the BETRAYAL of their
CONSTITUTION and COUNTRY then it would be the greatest TREASON by a
Monarch since James II who sold our COUNTRY to the FRENCH for MONEY and

We now learn from the Daily Mail COMMENT
on Christmas Eve that the Queen's Speech will cover the catastrophic
fall in Values and Moral behaviour since the beginning of her 56 -year
reign. This has been brought about by the actions of HER MINISTERS and
the greater number of those in HER PARLIAMENT who have placed THEIR
CONCERNS before the INTERESTS of THE PEOPLE and NATION STATE.
As for the fact that HER PEOPLE feel
LOST that has been the direct result of the actions of HER SUCCESSIVE
GOVERNMENTS and the TRAITOROUS POLITICIANS including PRIME MINISTERS who
have stealthily over the 56 years of HER MAJESTY'S REIGN have almost
achieved their aim of ENSLAVING the PEOPLE to a FOREIGN POWER.
The reason for the marked drop in the
number viewing THE QUEEN'S SPEECH is no doubt because the mass of people
have realised years ago that the MONARCH is powerless to PROTECT their
WAY-OF-LIFE and events up to now have PROVED THEM CORRECT.
There is a well know saying

Is
it the case on Christmas Day 2007 while the Monarch talks our Rights
and Liberties are being taken from us under our very noses?
Of
course the QUEEN under HER CONSTITUTIONAL ROLE can only 'Advise and
Warn' HER MINISTERS but when the matter concerns the very LIFE of an
INDEPENDENT STATE we expect that HER MAJESTY consider the arrangement to
be AT AN END as it would make a MOCKERY of the PRIME IMPORTANCE of the
MONARCH to protect our inherited Rights and Liberties which HER
MINISTERS are endeavouring TO GIVE AWAY.
We as loyal subjects of the MONARCH who
is the living embodiment of OUR RIGHTS and LIBERTIES ask at this late
stage with only months to the eradication of a FREE NATION STATE some
veiled comments that HER MAJESTY will PROTECT our RIGHTS and LIBERTIES.
As for the MORAL tone of the NATION STATE
at this most crucial time in ENGLISH CONSTITUTIONAL HISTORY this matter
should be left to CHURCH LEADERS who's responsibility it is to CARE for

IF HER MAJESTY'S SPEECH has not been
pre-recorded we ask HER MAJESTY to give those MILLIONS of HER subjects
some hope that their PROTECTOR has NOT FORGOTTEN THEM.
