BRITAIN'S voting system is 'archaic' and divisive' and does not represent the will of millions, a pressure group has argued. The Electoral Reform Society, which has campaigned for proportional representation for 130 years, claimed last month's General Election was the most disproportionate ever. It said UKIP would have WON up to 80 seats using the type of PR used in many European nations, while the GREENS would have got 20. UKIP and the GREENS received 5MILLION VOTES, but under the FIRST-PAST-THE-POST system ended up with ONE MP each. TONY BLAIR was accused yesterday of a fresh cover-up over the invasion of Iraq after Downing Street refused to surrender e-mails and other sensitive documents requested under the

Freedom of Information Act.

Labour MPs and Liberal Democrats called for the release of all relevant information about the deliberations of

Lord Goldsmith-the Attorney General

-who has been accused of buckling under pressure when he declared the attack to be legal in a statement to Parliament on March 17,2003.

The criticism followed the release yesterday by the Cabinet Office and the Attorney-General’s office of a “disclosure statement” purporting to provide more information about Lord Goldsmith’s thinking and discussions in the days leading up to the invasion.

The statement, which shows how the Attorney General changed his mind on the legality of military action, was forced out of the Government following the issuing earlier this week of an enforcement order by the Information Commission’s Office (ICO), which administers the Act.

It was responding to complaints from individuals or bodies who had tried and failed to secure access to relevant material under the FOI Act.

Richard Thomas, the Commissioner, justified the disclosure of the Attorney general’s advice, which is by tradition confidential by citing the

PUBLIC INTEREST.

He said:

“This is an exceptional complex and sensitive case which raised many issues.

As the Government chose to outline an unequivocal legal position on such a critical issue at such a critical time, the balance of the public interest calls for disclosure of the recorded information which lay behind those views.”

But he also used the issue of “public interest” to rule out the disclosure of “uncirculated drafts, reservations or possible counter-arguments.

Those documents, said critics, were vital to understand the power-play at work before the war.

Clare Short, the former International Development Secretary who resigned from the Cabinet over the war, said the inadequate FOI release underlined the case for a

HIGH JUDICIAL INQUIRY.

“We know from the Hutton Inquiry how the e-mails show a lot of the true events,” she said.

“If we have them they would show the pressure put on the attorney

Peter Kilfoyle, the Labour backbencher and former Defence Minister said the disclosure statement was nothing more than a “smokescreen”

“ The only thing we learn is that Goldsmith changed his mind after taking his advice from Sir Jeremy Greenstock [British ambassador to the UN in 2003] and the US administration.

Why wasn’t he talking to international jurists?

This was a point of law that should have been addressed as a point of law.”

[Well! to the majority of mankind the answer seems simple -the British Government had a deadline for war and nothing was going to stop it - not any legal technicality anyway.

There needs to be a constant daily barrage of questions sent to the FOI until they realise that the matter is not going to rest until the FULL relevant information is given.

What was the point of the

Freedom of Information Act

if the person responsible for carrying out the Act is unable to do so. Future legislation should be forthcoming to enable FULL disclosure instead of the drip-feed of the present.]

In his March 17 statement, Lord Goldsmith said the attack was clearly justified in International Law by existing UN resolutions on Iraq.

BUT, said Mr Thomas, the Attorney- General’s confidential advice to the Prime Minister on March 7 had been “significantly more equivocal in nature”

Questions about the reasons why Lord Goldsmith changed his advice have been raised by critics.

However, the Attorney-General has dismissed as “fantasy” widespread claims that Government colleagues had “leant on “ him to justify their invasion plans.
