The Americans seem to want to own everything - including your body - and at the rate they are going they soon will.

American patent law is now so pliable (and American influence over the rest of the world so great) that there seems little doubt that a few drug companies will, between them, soon own our bodies.

One company alone (Human Genome Sciences) is said to have patents on most of 70,000 human genes.

An American company has been given a patent on all human blood cells obtained from the umbilical cord of new born babies.  In the past, these cells were used WITHOUT CHARGE to treat other patients.  IN FUTURE, licence fees will have to be paid to the company which has the patent  on these human cells. (HOW LONG before someone patents the gene for RED HAIR and then claims a royalty from the parents of every red haired child)

Many companies are patenting raw genetic data without having any idea of the value of what they are patenting. IT'S A GOLD RUSH but no one yet knows which are the gold nuggets and which are worthless bits of stone....

One big American company has allegedly already refused to share its findings with publicly funded researchers.

It is now commonplace for American doctors to claim to own potentially life-saving medical procedures.

Evenour own human genetic make-up is being snapped up by greedy doctors and scientists turned entrepreneurs . One third of human genome which has so far been mapped is privately owned. A staggering eight thousand USA patents have been issued on HUMAN GENES and METHODS and TECHNIQUES related to their existence.  Like it or not we are likely to wake up one day soon and find out our bodies are owned by Americans. Fall over and graze your arm and you'll have an American lawyer on your doorstep claiming $5 million because you have damaged HIS PROPERTY.

Already in the USA, hospitals are fighting researchers about who owns NEW TREATMENTS, and genetic engineering firms are spending FORTUNES on LAWYERS as they claim patents over bits and pieces of the HUMAN BODY

American courts have even stopped doctors prescribing treatments when rival companies have claimed to own part of the underlying technology.

For example, cancer patients in the USA have been refused treatment with a drug made by one company because the second company claims its rights are being infringed - even though it does not have an alternative drug to offer.

Two things - apart from greed and absence of any sense of public responsibility among American doctors, scientists and businessmen - are helping to make this greed-fest into a serious problem.

First, the rules about obtaining patents have changed in the USA. In the old days you could get a patient if you came up new type of wheel. these days you can even get a patent ( and therefore a monopoly) on the idea of having a wheel. (You probably think I'm exaggerating. I'm not.

USA patent No 5,707,114 is entitled

'Vehicle wheel'

and is for exclusive rights to the wheel, including 'an annular rim, a central hub and a plurality of spoke portions running between the rim and hub'.)

When one American company applied for patent protection for its genetically modified cotton plant it was given a patent for all genetically engineered cotton - however it was made. If most varieties  of cotton in the future are genetically engineered then that company will have, effectively, patented cotton....

An American eye surgeon patented a particular type of cataract operation - and told other surgeons that they would have  to pay a royalty every time they wanted to perform the procedure.  one doctor owns the rights to a basic suturing technique.   Another has the rights to the technique of making a slit in a skin graft in order to expand it.    One doctor has patented the practice of applying the anaesthetic lidocaine to the skin to treat nerve pain associated with shingles.  Another American doctor owns the right to the idea of treating a nosebleed with a catheter wrapped in gauze.   A doctor has a patent on a technique to treat haemorrhoids.  (If you are SHOCKED and HORRIFIED by all this you may need to take a BREAK before you CONTINUE reading.

IT GETS WORSE.

 

[THE MADNESS EVEN GETS MUCH WORSE]

A radiologist in the USA has a patent covering the technique for determining the sex of the foetus aged twelve to fourteen weeks with ultrasound.  The patent relies upon the radiologists ability to distinguish male genitalia from male genitalia.  Although one radiologist compared this to having a patent to tell your right hand from your left, and another likened it to having a patent on the ability to distinguish the gender of patients when they remove their clothes, the patent is legally enforceable.

Human cells have been patented and genetic engineers claim that it won't be long before genetically engineered humans WILL BE MADE.  When that happens it seems reasonable to assume that the companies responsible for the technology will LEGALLY OWN these HUMAN BEINGS.  The USA GOVERNMENT has ruled that anything UNDER THE SUN that is made by MAN can be PATENTED.  So , a genetically engineered HUMAN can certainly be PATENTED.
