At this time of the year we remember the sacrifice which members of our Armed Forces make ; either the ultimate sacrifice of lose of life and those who from the advances of medical science are saved but with in many cases with injuries which might be considered too high a price to pay as they who suffer such a fate have a life of unending sacrifice to the end of their days.

Because of the great sacrifice that our service personnel give for their nation it is only right that they who make the decision of WAR and PEACE should be under scrutiny to insure that any conflict is not entered into unless it is vital to the security of our NATION STATE. Those in GOVERNMENT who deliberately mislead the HOUSE of COMMONS must face a charge of IMPEACHMENT for the GREAT WRONG that has been done. Though the procedure of such IMPEACHMENT was proceeded with by members of the HOUSE the guilty parties have up to now escaped their JUST PUNISHMENT. In fact REWARD seems to be the norm in such cases. If the EU TREATY is ratified over the following months by a treasonable HOUSE OF COMMONS then the BIG PRIZE of PRESIDENT of the EUROPEAN COUNCIL could well be our own WARMONGER  and top of the IMPEACHMENT LIST  Mr BLIAR.

What we have witnessed over the past decades is the refusal of GOVERNMENT and JUDICIARY to be bound by the respect  of customary common law from the past for honourable and just treatment to the PEOPLE in the protection of their LIBERTIES which is their DUTY TO SERVE.  Well over three centuries ago a civil war was fought by Parliament against a KING to protect our Ancient LIBERTIES and RULE OF LAW.

A great part of the breakdown of our country's cohesion and trust in politicians and governments has been the slow process by stealth and deceit  on a steady slide of our once FREE and INDEPENDENT COUNTRY into the corrupt unaccountable and despotic police state THE EUROPEAN UNION which could only be achieved by the connivance of our JUDICIARY which in 2007 has almost achieved  the deliberate destruction of our FUNDAMENTAL LIBERTIES and ANCIENT FREEDOMS.

In 1641 only months away from a civil war during the Long Parliament there was the IMPEACHMENT of LORD KEEPER FINCH, and then of a  high proportion of common law judges who were responsible for the Shipmoney judgment in Hampden's case.

Finch was accused of:

'having traitorously and wickedly endeavoured to subvert the fundamental laws and established government of the

REALM of ENGLAND

-and instead thereof , to introduce an arbitrary tyranical government  against law'

Have not all governments with the help of the common law JUDICIARY since 1972 been guilty of treason when their actions are considered in the light of the above judgment?

 

We have seen over the past 35 years the same misuse of the prerogative to usurp the

'Rights and Liberties '

of Englishmen.

 

Those who have died  for their country and those who will carry their wounds to the end of their lives

IF THE HOUSE OF COMMONS CANNOT DO IT THEN WHY ARE THEY THERE?

We need at this hour to remind ourselves that many of our forebears crossed the Atlantic many centuries ago and having in mind their English heritage of Rights and Liberties on the 4th July 1776 in their

United States' Declaration of Independence

 two  sentences from its historic declaration have inspired oppressed peoples everywhere to seek to follow the message of FREEDOM of that

UNITED STATES OF AMERICA

as we do today on the 1st November,2007.

'We hold these truths to be self evident. That all men are created equal. That they are endowed by their creator with certain inalienable rights. That among these are life, liberty and the pursuit of happiness. That to secure these rights, governments are instituted among men, deriving their just powers from the consent of the governed .That whenever any form of government becomes destructive of those ends, it shall be the right of the people to alter or abolish it, and to institute new government, laying its foundations upon such principles, and organising its powers in such form, as shall seem to them most likely to effect safety and happiness.

A great many people in our country today value the links and special relationship with the United States and the closeness of our constitutional law particularly our common law to them and other parts of the world where our ancestors settled and to which in our own day there are still close family ties.

George Bush is President of the USA but he is

NOT THE PEOPLE

In fact at his Inauguration there were massive demonstrations which showed how hated he was by many of his people who are looking forward to his end of term next year. However, he is still capable of more disastrous moves on the world scene.  And whether he forms closer relations with Germany by shaking the hands of Chancellor Angela Merkel or of France of President Sarkozy the links between the USA and Britain or as was the expression for many years

ENGLAND

are such that even politicians know that those links from the past have been there in peace and war ,though it was the initial blood of our nation and our economic sacrifice in two World Wars which we led the way before our American allies came to join the fight against Bismarck and Hitler as would we against any who threatened our country. But we are not silent partners and there will be differences but in the main we know who our true friends are and that friendship does not make us uncritical or less stalwart where there is need to do so. 

BUT

as Andrew Alexander Columnist stated in the following extracts in the Daily Mail article on November 2, 2007 of the possible plans of George Bush in his article

A RATIFIED LISBON TREATY WILL TAKE AWAY YOUR ONCE FREE NATION STATE AND AT THE SIGNING CREATE A UNITED STATES OF EUROPE  -SUPER-STATE.

The treasonable  Lisbon Treaty should have brought millions onto the streets -our greatest landmarks such as Trafalgar Square -The Mall-and around Buckingham Palace filled with protesting subjects of the Queen demanding that HER ministers reject the

TREATY which must NOT BE SIGNED by HER MAJESTY THE QUEEN the sworn PROTECTOR of our ANCIENT  and SACRED FUNDAMENTAL RIGHTS.

All ministers of the CROWN have sworn an OATH:

"To bear faith and allegiance to the Crown and defend its jurisdiction and power against all foreign...powers...states."

WE MUST SEE THAT THEY HONOUR THAT PLEDGE.

Earlier we quoted the  words of Thomas Jefferson and we now end with the words of his great friend and colleague James Madison who with Alexander Hamilton and John Jay the creators of the American Constitution:

 

'No doctrine can be sound that releases a legislature from the control of a constitution. The latter is as much a law as the former, as the acts of the former are to individuals; and although alterable by the people who formed it, it is not alterable by any other authority; certainly not by those chosen by the people to carry it into effect. This is so vital a principle...that a denial of it cannot possibly last long or spread far'

 

Regretfully our JUDICIARY have ignored this principle since the 'Glorious' revolution of 1689  and it is why they were able since 1972 to politicise their decisions to further the aims of the EU in order to destroy our

ENGLISH CONSTITUTION.

The followiong extract from a paper read on the 29th December,1937 at the annual meeting of the American Historical Association held in Philadelphia, Pennsylvania on the 150th anniversary of the U.S. Constitutional Convention of 1787

...but  no one who knows anything of modern English Cabinet Government would venture to say that it is a system of checks and balances, and what little check survived to the beginning of the century (20th) was in large part swept away by the

Parliament Act of 1911

 in taking from the Lords the legal right permanently to block an action of the cabinet (or more correctly in 2007/8 -the dictatorial prime minister) approved by the

House of Commons

What is more vital for us here in America is the bearing on our own present constitutional problems of this history of the past, and above all the history of the last twenty-five years (since 1911).

Since the English civil wars of the seventeenth century there has been  no challenge to constitutional government such as we have witnessed in this last decade [facing the Nazi/Italian/Japanese dictatorships in the world as in 2007/8 we in England face the destruction of our Nation State by the actions of our OWN

HOUSE of COMMONS]

There is a tidal wave of despotism sweeping the world [As we find today in 2007] On this anniversary of our [U.S.] Constitution we find constitutionalism itself threatened everywhere [as we find in 2007] as it has never been threatened since the founding of our

[U.S. GOVERNMENT]

We are meeting in Philadelphia this year in circumstances as critical as those the framers of our Constitution faced in 1787 [as we in England in 2007/8 face with the destruction of our Nation State] Do we realise as fully as they realised the crisis we have to meet ? [again as we do in 2007/8 in England]

Does any the history of constitutionalism suggest any cause of that crisis [yet again as in 2007/8] Above all, can past experience furnish any help in finding a remedy? [The difficulty in 2007 and in fact since 1972 when we entered the EC when in reality it was already the EU when a possible solution to the warring nations of Europe was put into place by those who dreamed of a soviet style European Super -State which as Winston Churchill warned was not for England but for Europe. But our traitorous politicians had other ideas and that is why we face the annihilation of our Nation State of England of 1400 years in the making.]

I have attempted the analysis above because I believe this past history does indicate one important cause, and also the  one possible line of defence. The cause, in a word, is the feebleness of government. It must be strengthened. The present danger is despotism [as it is in England in 2007] It must be prevented, and by legal limitations on government. [Unfortunately, at the Glorious revolution of 1689 the English did not put in place the necessary protection for its

FUNDAMENTAL RIGHTS

 as was the wish of Oliver Cromwell during the seventeenth century civil wars.]

If  weakness is the cause, no true remedy can lie in increasing that weakness; it can lie only in making government effective, in removing such "balances" as prevent prompt and decisive action; but also in seeing to it that such action can never jeopard the just rights of any. [This is not of course the problem with England  in 2007 and over the past 35 years, quite the contrary because the Government has had too much power -in fact unlimited power and that is why we are only months away from our country being taken from us.]

We must preserve and strengthen those bounds beyond which no free government ought ever to go, and make them limits beyond which no government whatever can ever legally go. [WE AGREE!]

We must make  ultra vires all exorbitant acts of government. [WE AGREE!]

If the STATES which are still constitutional hope to remain so far the future, they must make their governments strong enough to defy despotisms which now threaten their destruction; but above all, as the history of constitutionalism also shows, they must never let this strength become a lawless usurpation, divorced from right, under which individual liberty is trampled under foot before your eyes in so many parts of the world to-day, and may in time become only a memory even here [as in England in 2007 and over the past decade.]
